Point Wells Development Can Move Ahead After Appeals Court Ruling

A three-judge panel found that earlier, more lenient development rules apply to the project.

The proposed Point Wells development to build some 3,000 housing units, including high-rise buildings up to 18 stories tall, can move forward now that a three-judge Appeals Court panel has thrown out a King County Superior Court judge’s decision to halt the development.

The Appeals Court ruling Monday found that more lenient development rules, which existed at the time of application, apply to the project.

Woodway and the Shoreline neighborhood group Save Richmond Beach had sued Snohomish County and developer Blue Square Real Estate, citing modified development regulations.

An attorney for Blue Square told The Herald of Everett that the Appeals Court decision brings clarity but that the development process will be long. (Read The Herald’s full story here.)
